Checkout Policies

Tour Availability: All bookings are subject to tour availability. In the rare event that a tour becomes unavailable after your payment, we will notify you immediately and offer a full refund or an alternative tour of equal value.

Voucher/Ticket Delivery: Your e-voucher or tickets will be attached to your confirmation email. Please print this or have it ready on your mobile device to present to your tour guide at the designated meeting point. Specific meeting instructions are included on your voucher.

Terms & Conditions

These Terms & Conditions constitute a legally binding agreement between you and NY Fun Tours, outlining the rules and responsibilities for using our services.

Booking and Payment:

Full Payment Required: All tours require full payment at the time of booking.

Price Inclusions: Each tour description clearly lists what is included in the price (e.g., guide services, specific transportation, entrance fees). Please read this carefully.

Price Exclusions: Unless explicitly stated, prices do not include: personal expenses, meals, drinks, souvenirs, local public transportation fares (unless specified), gratuities for guides/drivers, or any optional activities not part of the standard tour itinerary.

Participant Requirements & Conduct:

Age Restrictions: Most of our tours are suitable for all ages, but some may have specific age restrictions (e.g., bar tours, certain historical tours with mature themes). Please refer to the individual tour description. Minors (under 18) must be accompanied by an adult.

Physical Fitness: Many tours involve walking and standing for extended periods. Please review the tour description for physical demands. Participants should be in good general health and comfortable with the indicated activity level. If you have mobility concerns or require special assistance, please contact us prior to booking to ensure we can accommodate you.

Medical Conditions: Participants are responsible for informing All NY Fun Tours of any medical conditions, allergies, or health issues that may affect their ability to participate safely in the tour. We are not responsible for any health issues arising during the tour.

Code of Conduct: Participants are expected to behave respectfully towards guides, fellow participants, local residents, and the environment. All NY Fun Tours reserves the right to remove any participant from a tour without refund if their behavior is disruptive, abusive, or endangers themselves or others.

More About Changes and Cancellations by the Customer:

  • How to Cancel: All cancellations must be submitted in writing via email to Info@allnyfuntours.com.

  • The cancellation timestamp will be based on the email receipt time.

  • Changes to Bookings: Changes to tour dates or participant numbers are subject to availability and may incur an administrative fee of ] per change if requested within 72 hours of the tour. No changes can be made less than 72 hours before the tour.

Changes and Cancellations by All NY Fun Tours:

Right to Modify/Cancel: All NY Fun Tours reserves the right to modify tour itineraries, substitute guides, or cancel tours due to unforeseen circumstances beyond our control (e.g., extreme weather conditions, natural disasters, political unrest, significant events causing closures, insufficient bookings, operational issues).

Notification: We will endeavor to notify you as soon as reasonably possible of any changes or cancellations.

Refunds for Operator Cancellations:

If All NY Fun Tours cancels a tour before it begins, you will be offered a full refund or the option to rebook for an alternative date or tour of equal value.

If a tour is interrupted or significantly altered due to unforeseen circumstances after it has commenced, we will offer a partial refund proportional to the unused portion of the tour or a credit for a future tour, at our sole discretion.

Force Majeure: All NY Fun Tours is not liable for any delays, cancellations, or damages resulting from events of "Force Majeure" (e.g., acts of God, war, terrorism, civil strife, industrial disputes, adverse weather, fire, epidemics, pandemics, government restrictions, or other events beyond our control).

Liability & Disclaimers:

Assumption of Risk: Participation in any tour involves inherent risks, including but not limited to, walking on uneven surfaces, exposure to weather conditions, and interactions with the public in urban environments.

 

You voluntarily assume all risks associated with participation.

Limitation of Liability: All NY Fun Tours, its employees, agents, and affiliates shall not be liable for any personal injury, death, property damage, loss, delay, or expense resulting from your participation in our tours, except where such liability cannot be excluded by law. Our liability is limited to the cost of the tour.

Travel Insurance: We strongly recommend that all participants purchase comprehensive travel insurance that covers trip cancellation, medical emergencies, personal liability, and loss of personal belongings.

Third-Party Services: All NY Fun Tours may utilize third-party suppliers (e.g., transportation companies, museums, restaurants). We are not responsible for the acts or omissions of these third-party suppliers.

Governing Law: These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.

Non-Refundable Items: Please note that any non-refundable deposits, administrative fees, or third-party service components (e.g., pre-purchased attraction tickets that are non-transferable) as specified in your tour description, are non-refundable.

Digital Product Policy

This policy will appear during checkout if there is a digital file in your cart (e.g., a downloadable NYC neighborhood guide, a virtual tour recording).

Instant Digital Delivery: All digital products are delivered electronically via a download link provided immediately upon successful payment on the order confirmation page and in your confirmation email.

No Physical Shipment: Please note that no physical product will be shipped for digital purchases.

No Refunds for Digital Products: Due to the instant, non-returnable nature of digital products, all sales are final once the download link has been provided. We do not offer refunds or exchanges for digital products unless there is a confirmed technical fault with the file itself that we are unable to resolve.

Usage Rights: Digital products purchased from All NY Fun Tours are for your personal, non-commercial use only. Redistribution, resale, or commercial use of our digital products is strictly prohibited.

Meeting Points & Punctuality: All NY Fun Tours have specific meeting points and scheduled start times listed on your tour voucher. Please arrive at least 10-15 minutes prior to the scheduled start time. We operate on a strict schedule to ensure the best experience for all participants; late arrivals may miss the tour, and no refunds will be issued for missed tours due to tardiness.

Weather Conditions: Our tours operate rain or shine, embracing the dynamic nature of New York City. Please dress appropriately for the weather, including comfortable walking shoes. In cases of severe weather that poses a safety risk (e.g., blizzards, extreme heat warnings), All NY Fun Tours reserves the right to cancel or modify tours (see Terms & Conditions).

All Ny Fun Tours offer tours through various modes to suit different preferences:

Walking Tours: These are a significant part of their offerings, allowing for in-depth exploration of neighborhoods.

SUV Tours: For those who prefer more comfort and wider coverage, we provide private SUV tours with licensed guides, often with "hop-on/hop-off" flexibility.

Specialty Vehicles: We mention options like a Dodge Challenger R/T Convertible for a unique touring experience.

Pedicab Tours: Specifically for exploring Central Park.

Private Coach Bus: 

Public Transportation: Many of our tours utilize New York City's excellent public transportation system (subways, buses).

 

Please note that standard MetroCard fares are generally not included in the tour price unless specifically stated. You will be responsible for purchasing your own MetroCard or utilizing contactless payment methods. Your guide will provide assistance.

Photography & Media: We love it when you capture your memories! We encourage personal photography.

 

Please be mindful of other participants and our guides. By participating in a tour, you grant Alll NY Fun Tours permission to use photographs or videos taken of you during the tour for promotional purposes (e.g., website, social media), unless you explicitly notify your guide or contact us in writing to opt-out.

Accessibility: New York City can be challenging for accessibility. While we strive to make our tours as inclusive as possible, some routes or attractions may not be fully accessible for wheelchairs or strollers. Please contact us in advance if you have specific accessibility needs so we can advise you on suitable tours and make any possible accommodations.
